What many applicants may not realize is that, nowadays, the first hurdle in applying for a job is dealing with AI. Candidates now often must clear an artificial intelligence system that screens their résumés that quietly determines who advances, and whose application is filed away in a drawer or spam folder, never to see the light of day. Now, a new lawsuit filed on Tuesday is the first in the U.S. to accuse an AI hiring company of violating the Fair Credit Reporting Act. Eightfold AI, a venture capital-backed artificial intelligence hiring platform, is being sued by two workers in California for allegedly compiling reports used to screen job applicants without their knowledge, consent, or any opportunity to correct errors.“I’ve applied to hundreds of jobs, but it feels like an unseen force is stopping me from being fairly considered,” said Erin Kistler, one of the plaintiffs, in a press release. Both plaintiffs applied to roles at several companies that use Eightfold AI, including PayPal and Microsoft, according to the complaint. Out of the thousands of jobs she has sought in the past year, only 0.3% of her applications have progressed to a follow-up or interview, Kistler told the New York Times. “It’s disheartening, and I know I’m not alone in feeling this way.”Eightfold AI’s algorithm trawls career sites, job boards, and résumé databases to create a data set of “1 million job titles, 1 million skills, and the profiles of more than 1 billion people working in every job, profession, industry, and geography”, according to their website—much of it “inaccurate, incomplete, or drawn from unknown third-party sources,” the complaint alleges. Using an AI model trained on that data, plaintiffs say, Eightfold AI scores job applications on a scale of one to five, based on their skills, experience, and the hiring manager’s goals. These AI-generated evaluations function as “consumer reports under the federal Fair Credit Reporting Act (FCRA) and California law,” the lawsuit alleges. Unlike credit reports (a type of consumer report which the FCRA regulates to ensure accuracy and fairness), applicants are given no feedback on their scores or how the rating was generated, rarely aware that an algorithm evaluated them at all. If the tool is making mistakes, candidates have no ability to correct them. This creates a “black box” situation where we can see what goes into an AI system, and what comes out. But the reasoning in between remains hidden or incomprehensible to humans or the employers relying on the scoring when considering potential hires. This opacity is troubling at a time when more companies are relying on AI for hiring and candidate screening. A spokesperson for Eightfold AI told Fast Company that “this characterization about our products is factually incorrect. Eightfold offers technology that enterprises use to manage their talent processes and engage with candidates. Eightfold does not ‘lurk’ or scrape personal web history, social media or the like to build secret dossiers. Eightfold’s platform operates on data that is submitted by candidates to our customers or provided by our customers.” They continued: “We use information such as skills, experience and education that applicants choose to submit to our customers and data authorized by our customers under contract.” They also pointed to their blueprint to learn more about their specific data practices. The plaintiffs, meanwhile, are not demanding the elimination of AI from hiring. Instead, they are asking for AI companies to be held to the same standards as others. “Just because this company is using some fancy-sounding AI technology and is backed by venture capital doesn’t put it above the law,” David Seligman, Executive Director of Towards Justice, said in the press release. “This isn’t the wild west.”Still, as AI becomes more pervasive in hiring, legal conflicts like this may just become more and more common.

He has also created wands, bracelets, crowns and other items. “I always want to break new ground,” Alan says. “My interest is always what's next. So I'm always playing and coming up with neat new things.”____________Within weeks, he had a second sale, and business began to pick up online. Google sent troves of customers his way, as Alan’s website appeared at the top of the page when people searched for braided wedding rings or unique wedding rings online.In recent years, however, competition stiffened.“How the heck does a little guy in a shop compete with Tiffany or something like that?” Alan says. To get web traffic, he began paying $60,000 annually for clicks about four years ago.“We were 100% dependent on these pay-per-clicks to keep us alive,” Alan adds. “It was panic.” If clicks were down, the business scrambled to figure out why and fix it.Says Alan: “You're constantly playing with those levers.”Sarasota storesAlan came to Florida in 2016 to set up shop on St. Armands Circle, above the Columbia Restaurant.Next, the business moved across from Crab & Fin to a storefront on one of the “spokes” of St. Armands Circle, Alan says, in an attempt to get more foot traffic. After not making any money there because everything went toward rent, he continues, the business moved to the Burns Court area of downtown Sarasota on Pineapple Avenue.Todd Alan Studios had been leasing downtown for a handful of years when the rent was set to double.“We were vulnerable,” Neff says.After an extensive search, the business found a space in Sarasota’s Rosemary District — and this time it acquired it instead of renting. The business, through Todd Alan Properties LLC, purchased Unit 106 at 1542 4th St. last June for $475,000, according to Sarasota County property records.“We managed to get the financing, and we took the leap, and now we own our own store,” Alan says. “Our mortgage is less than we were paying in rent.”The store hosted a grand opening in November.“There's a feeling about owning. It's stability. Since then, her company has been posting for the business regularly.Todd Alan Studios has created more than 400 videos through January, he says. “We’ve got more than a million followers across platforms,” Alan says. “We have one real blessing that kind of helped kick things off in the form of a squirrel.”In late 2023, Alan had been caring for a baby squirrel that was abandoned near their store, and it became attached to him, he says. While they were making a video one day, his daughter pulled out a wand that he had created for her as a child and surprised him.“As I'm talking about it, this squirrel runs up around my shoulder, and it doesn't even faze me,” Alan says. “It's a story in a story with a surprise outcome” and was “an overnight game changer — suddenly we had all these followers, you know? Then again, Vrabel has plenty of experience winning Super Bowls, allowing him to share his knowledge of both sides.That’s been helpful during New England’s playoff run, in a season where nobody expected it.“With him being a player, I feel like he always — he’s still got it in the back of his mind what makes players click and what gets us going in the right direction, believing in each other,” Milton Williams said. “When we go out there, we’re going to lay it on the line for him.”Vrabel, as he’s done time and time again this season, deflected when asked about his role in motivationing players. It’s all about the players, after all.“I don’t know that players need to be motivated, I think they’re motivated,” Vrabel said. “I hope it’s to win a championship, a Super Bowl. I mean, as high school players — whatever motivates you. “We’re trying to inspire them, and give them confidence and trust in doing their job. The fire department says this shows you the importance of shoveling out hydrants near your homes so that firefighters don’t have to climb over the snow banks in an emergency.No injuries were reported, according to the fire department.
